Terms of Service

These terms govern your use of the plaque, QR code and file hosting service run by NERGtags ("we", "us"). By creating an account or using the service you agree to them.

1. The service

We sell plaques that carry a QR code. After you claim a plaque with its activation PIN, you can make it send people to a web address you choose (Basic plan) or show PDF files you upload (Deluxe plan). You can change these settings at any time and download the QR code image.

2. Your account and your plaques

You must be at least 18 years old and give us a valid email address. Keep your password and your plaques' activation PINs secure. Whoever has a plaque's PIN can claim it before it has been claimed, and you are responsible for activity under your account. If you sell or give a plaque to someone else, release it from your dashboard first.

3. Acceptable use

You may not point a plaque at, or upload to the service, anything that:

You also may not interfere with the service, try to access other customers' accounts or files, or use automated means to create accounts or upload files in bulk.

4. Files you upload

Files you upload are available to anyone who scans or opens your plaque. Do not upload anything private. You keep ownership of your files and give us permission to store and deliver them to run the service. You are responsible for the files you host and for having the right to share them.

5. Reports and enforcement

Anyone can report a plaque to us. We may review reported plaques and files and may disable any plaque, remove files, or suspend or close any account at our discretion, with or without notice, if we believe these terms have been broken or content may cause harm. We may share information with law enforcement where we believe it is appropriate or required.

6. Plans, free trial and payment

Each plaque has its own plan. Every plaque comes with a free Basic trial of 60 days, which starts the first time the plaque is claimed and is not restarted if the plaque is later released and claimed again. After a plaque's trial ends, it stops working unless it has an active paid subscription. Paid plans (Basic and Deluxe) are billed per plaque, in advance on a recurring basis, through our payment processor, Stripe, and renew automatically until cancelled. You can cancel or change a plaque's plan at any time from its Manage billing button; paid features continue until the end of the period you have paid for. When a subscription ends, that plaque stops working or loses features your plan no longer includes, and we may delete its hosted files after a reasonable period. If you release a plaque or delete your account, the subscriptions for the affected plaques are cancelled immediately without refund. We may also give some accounts free access at our discretion and may end it at any time. Fees are non-refundable except where required by law. We may change prices with advance notice before your next renewal. Plaques themselves are sold separately and are subject to the seller's return policy.

6a. Buying plaques

Prices, shipping charges and any sales tax are shown at checkout, and payment is taken by Stripe when you order. Plaques are shipped to the address you enter, and delivery times shown are estimates. Many plaques are made to order. [YOUR RETURN AND REFUND POLICY HERE: for example, how many days customers have to return an unused plaque, who pays return shipping, and what happens with damaged or lost items.] A plaque's activation PIN is printed on the card in the box: keep it private, because anyone with the PIN can claim the plaque until it has been claimed. Buying a plaque includes the free trial described in section 6, but not a paid plan.

7. Availability

We aim to keep the service running but do not promise it will always be available or error-free. Printed codes depend on our domain and servers staying online. If we decide to shut the service down we will give at least 30 days' notice by email.

8. Important: do not rely on a QR code alone

QR codes can be damaged, fail to scan, or point to a page or file that is out of date. Do not rely on a plaque from this service as the only way to provide emergency, medical, safety or child-identification information.

9. Disclaimers and limits of liability

The service is provided "as is" and "as available", without warranties of any kind to the extent the law allows. To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for lost profits or data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

10. Ending your account

You can delete your account from the Account page at any time (cancel any subscription first). We may suspend or end your access if you break these terms.

11. Changes

We may update these terms. If we make material changes we will notify you by email or in the dashboard. Continuing to use the service after a change means you accept it.

12. Governing law

These terms are governed by the laws of OHIO, without regard to conflict-of-law rules.
